Penn State: Court Should Dismiss Spanier’s Lawsuit

BELLEFONTE, Pa. (CFB/Newsfeed) — Penn State is asking a judge to dismiss a lawsuit filed against the university by its former president.

Graham Spanier (SPAN’-yer) sued May 25 to obtain old emails that he says are necessary to respond to Penn State’s child sex-abuse probe.

According to the Centre Daily Times, the university contends it can’t disclose the messages because of an ongoing investigation by the state attorney general.

Documents filed by Penn State on Thursday in Centre County court also argue that Spanier should have first requested the emails under the state’s Right-to-Know law.

Penn State is conducting an internal investigation of how the university handled child molestation allegations against former assistant football coach Jerry Sandusky. Sandusky is currently on trial and has denied wrongdoing.

Murray State Football Player Dies

ELIZABETHTOWN, Ky. (CFB/Newsfeed) — A Murray State football player has died in Elizabethtown, where he had returned after his first year.

Elizabethtown police Sgt. David Neary confirmed Friday that Jeff Richard died Thursday but gave no further details.

The Hardin County coroner’s office didn’t immediately return a call Friday.

The university said Richard, a defensive end, appeared in all 11 games last year, starting in the final three games of the season and finishing with 21 tackles, including five tackles for loss and a sack. Highlights include a blocked punt against Tennessee-Martin and recovering a blocked punt for a touchdown against Mississippi Valley State.

Richard played high school ball at John Hardin.

Coach O’Brien Kicks Off Penn State Caravan Tour

PHILADELPHIA (CFB/Newsfeed) — Dressed in a navy blue suit with a dark tie and a Penn State button pinned near his heart, new Nittany Lions football coach Bill O’Brien kicked off the first leg of a nine-day, 18-stop bus tour in Philadelphia on Monday.

Joined by head men’s basketball coach Pat Chambers and field hockey coach Charlene Morett, O’Brien received an enthusiastic welcome from about 250 alumni, former players and supporters who attended the luncheon at the Doubletree Hotel.

“I know it’s a very special place,” O’Brien said. “What I try to do every single day is go in there with our staff and our players, and work extremely hard to make sure that we carry on the tradition of winning football games and graduating players.”

It’s quite a task. After all, O’Brien replaced Joe Paterno, who died in January at age 85. And he was hired two months after the child sexual abuse scandal that erupted following the arrest of Jerry Sandusky. A retired defensive coordinator, Sandusky has proclaimed his innocence while awaiting trial scheduled to start in June.

But O’Brien is ready to move the Nittany Lions forward in this ultra-competitive landscape that is college football, while at the same time, embrace Penn State’s age-old tradition. It’s a difficult recipe to master, but he’s intent on trying.

“I want them to know,” O’Brien said, “that I’m in charge of a football program that is part of a great athletic program that is a part of a very special university.”

Those on hand certainly agreed Monday. And they were more than appreciative when hearing O’Brien, the former offensive coordinator with the New England Patriots, speak of the school’s long-standing staples, including the simple uniforms and traveling on blue buses.

“That’s what makes Penn State special,” said Joseph Lally, a former defensive end. “Riding in the blue bus as a player is so exciting and motivational. Wearing those uniforms made us feel pretty special, and they are the same, year in and year out.

“These are important traditions.”

After introductory remarks by the coaches, O’Brien fielded the majority of the questions from the generation-spanning fan base.

O’Brien has kept a busy schedule over the past few months as he has ingratiated himself in the community, despite his New England roots. He has made numerous campus appearances and talked with students.

Now, it’s his time to talk with former players and alumni who may or may not support the program as much as in years past. So, he’s hit the road to meet and greet. Former player Adam Taliaferro, whose recovery from a paralyzing spinal cord injury gained national media attention, thought the event represented a good chance for the fans to have some quality face time with the new leader.

“I’ve had the opportunity to speak to Coach O’Brien a couple times,” Taliaferro said. “He’s a great guy, and I think he’s going to be a great asset to Penn State University. It was great that everyone got to see him, got to know him as a person.”

Taliaferro added that the Penn State community shouldn’t be upset that O’Brien didn’t graduate from the school.

“When they first hired Coach O’Brien, I told him that all of us become Penn Staters at one point in our lives,” Taliaferro said. “None of us were born Penn Staters. I’m of the mindset that he’s our coach now. Let’s give him all the support we can.”

While many of the stops are in regions with strong Penn State ties, many are also in important recruiting areas. Some sites are both. On Tuesday, in fact, the caravan is scheduled to arrive in Baltimore and Washington, D.C. There will be a stop in Richmond, Va., on Wednesday.

Near the end of the trip – being run as season-ticket sales continue in State College – O’Brien will visit Hartford, Conn., the state that produced top tailback Silas Redd and linebacker Khairi Fortt. After that, O’Brien will visit Youngstown, Ohio, the hometown of former star quarterback Daryll Clark.

While other coaches will join O’Brien during the tour, only the football coach will be at each location. Clearly, he has the stage to show those “Penn Staters” just who he is, and what his program will eventually be.

“It’s a beautiful place here,” O’Brien said. “I was in the office the other day and (new offensive line coach) Mac McWhorter came in and said that he climbed Mt. Nittany on Saturday. When you get to the top – which I haven’t been able to do yet, eventually I will – he talked about the views and the people he met along the trail. It’s a great community here.

“It’s named Happy Valley for a reason.”

Utah State, San Jose State Acknowledge MWC Talks

SALT LAKE CITY (CFB/Newsfeed) – Officials at Utah State and San Jose State acknowledge they are in discussions with the Mountain West Conference over realignment for 2013 yet say no formal agreement has been reached.

Conference USA already is set to bring aboard Texas-San Antonio just months before the school was to begin its first season in the Western Athletic Conference.

The moves could mean the end of the WAC as a football league.

Utah State athletic director Scott Barnes is attending WAC meetings in Phoenix but acknowledged “things have progressed,” though no decision is formal.

San Jose State sports information director Lawrence Fan said Monday the school also has been in discussions to join the Mountain West.

Utah State and San Jose State have a history dating to their days in the Big West.

State, Feds Investigating Allegations Against Mickey Loomis

State and federal law officials have opened an investigation to determine if New Orleans Saints general manager Mickey Loomis violated wiretapping laws after allegations that a rigged device in his stadium suite allowed him to listen to opposing coaches’ conversations.

“The FBI invited us to come into their investigation,” Col. Mike Edmonson, superintendent of the Louisiana State Police, said Tuesday. “We assigned a trooper that works with the FBI to follow their investigation. These are allegations at this point. We deal with facts. We’ll look at everything to determine if there is anything to follow and see if state laws are violated on our end. The FBI is investigating federal laws.

“With all allegations, we’ll see if state laws were violated, and if so, we’ll visit with the district attorney to see where we proceed.”

The FBI declined to say if it was investigating the allegations, which Loomis has vigorously denied. Local FBI spokeswoman Sheila Thorne would only say the bureau is “in receipt of the allegations” and would “have no further comment.” She also declined to say who made the allegations.

ESPN’s “Outside The Lines” reported Monday that an unidentified source claimed Loomis ordered a device in his Superdome suite be re-wired so he could listen to opponents’ conversations through his own earpiece from 2002 to 2004. The report said it is unknown if Loomis ever used the device, which was located in front of his seat.

The Superdome was re-wired and remodeled, following the damage it sustained after Hurricane Katrina in 2005 and other upgrades made to the city’s landmark domed stadium, so that could make finding evidence of these allegations difficult.

Loomis could have violated state and federal wiretapping laws if he did listen to opponents without their knowledge, but the statute of limitations to prosecute him if he’s found to have used the device could have expired, based on the timeframe of the allegations. The federal statute of limitations is five years in such cases, and it’s six years according to Louisiana state law.

Even so, Loomis could face sanctions from the NFL if law enforcement or its own investigation finds wrongdoing. The league said the ESPN report was the first they’d heard of the wiretapping allegations but declined to say if it’s opening its own investigation.

“We heard the reports just as you did yesterday, and it’s something that U.S. attorney’s office will make a determination on and we’ll make a judgment from there,” NFL Commissioner Roger Goodell said Tuesday on “The Rich Eisen Podcast.” “We changed our technology a few years ago to where this would be impossible or near impossible to do in this day and age.”

Loomis, the Saints and other former team officials adamantly denied the claims. A team source said he wasn’t aware if law enforcement had interviewed Loomis about this recent accusation.

“This report on ESPN is absolutely false,” Loomis said in a statement e-mailed by the team. “I have a monitor in front of me in my booth that provides the league issued stats for the game. I have a small TV with the network broadcast and I have an earpiece to listen to the WWL-AM radio (flagship broadcaster) game broadcast. To think I am sitting in there listening … and or doing something with the offensive and defensive play calls of the opposing teams makes this story and the unnamed sources that provided the false information that much more less credible … it just didn’t happen.”

Edmonson said he hasn’t put a timeframe on the investigation, but “we owe it to the people involved to do an expeditious investigation but do a thorough investigation and fair investigation that maintains the highest level of integrity and professionalism.”

The allegations against Loomis come during an ugly offseason for the Saints, who are embroiled in a “bounty” scandal that resulted in coach Sean Payton being suspended for the season, Loomis for eight games and assistant head coach Joe Vitt for six. The team also was fined $ 500,000 and docked second-round draft picks this year and in 2013 for a bounty program that financially rewarded defensive players for hits that injured opponents.

CJ Leslie Returning to NC State Basketball Team

RALEIGH, NC (CBB/Rivals) – Basketball standout C.J. Leslie is returning to North Carolina State for his junior season, a decision that will make the Wolfpack one of the favorites in the Atlantic Coast Conference next year.

The 6-foot-8 forward averaged a team-best 14.7 points and was second with 7.3 rebounds per game. The deadline for players to declare early for the NBA draft was April 29.

“I wanted to take my time as much as possible,” Leslie said during a news conference Wednesday afternoon. “I knew I had time. It’s one of those things you can’t help but to think about. I tried to take as much time as I needed and made the best decision for me.”

Leslie helped the Wolfpack (24-13) surge late in the year to reach the NCAA tournament for the first time since 2006. N.C. State pulled two upsets to advance to the round of 16 before losing a close game to national runner-up Kansas, but the team will return its top four scorers and add three McDonald’s All-Americans for coach Mark Gottfried‘s second season.

“We got a little taste of it last year,” Leslie said of the attention that came with the NCAA run. “We took it well. I know I’m going to be ready for it and I expect my teammates to be right there with me.”

Leslie said one of those incoming freshmen, Rodney Purvis, had kept the pressure on Leslie with texts and calls trying to convince him to return to school. Purvis, a guard from Raleigh, was the Associated Press men’s prep basketball player of the year for North Carolina.

Still, Leslie said he was leaning toward returning to school from the start.

“It was a tough decision,” he said. “That’s a big decision to make for anybody. I just figured we started a good thing last year. I might as well finish it.”
